LX INDIA - Terms of Use

This Agreement sets forth the terms and conditions governing your access to and use of the services made available through a designated account or accounts and constitutes a binding legal contract between you, (here in after referred to as "user,” "buyer,” "customer,” "you,” or "your”) shall mean any natural or legal person who has agreed to become a user on Platform by providing data while registering on the Platform as Registered User, and Levelx Micro Systems (OPC) Private Limited (hereinafter referred to as "LX INDIA,” "we,” "us,” or "our”).By completing the registration process for, or by accessing or using, any of the services provided by LX INDIA, you expressly acknowledge, agree, and undertake to be legally bound by all provisions of this Agreement, including, without limitation, the applicable Service Terms and Program Policies governing each specific service that you register for or utilize in connection with the LX INDIA platform.For the purposes of interpretation, the terms "we,” "us,” and "LX INDIA” shall refer to the LX INDIA entity identified in the applicable Service Terms.

Registration

The access to, and use of, the Platform and its associated services shall be strictly limited to individuals and entities legally competent to enter into binding contracts in accordance with the provisions of the Indian Contract Act, 1872. Persons who are deemed "incompetent to contract” within the meaning of the said Act including, without limitation, minors, un-discharged insolvents, or persons of unsound mind are expressly prohibited from accessing, using, registering on, or transacting through the Platform in any capacity.In particular, any individual who has not attained the age of eighteen (18) years shall be deemed ineligible to register as a user, execute transactions, or otherwise utilize the Platform. Should it come to the knowledge of us whether through direct information, discovery, or verification that a user is under the age of eighteen (18) years or otherwise legally incompetent to contract, we reserves the unconditional right to immediately terminate such registration, cancel any pending transactions, and deny or restrict further access to the Platform without prior notice.

Your LX INDIA Account

Account Creation

To buy products on LX INDIA, you must first create an account by providing required information such information shall include, but shall not be limited to, your name, phone number, email address, and delivery information. You agree to keep your account information secure and up to date at all times.

Your account should represent your real identity using false names or impersonating others is strictly prohibited. Whenever your personal or contact details change, it is your responsibility to update them immediately to ensure a smooth shopping experience and accurate delivery of orders.

Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.If you notice any unauthorized access or suspicious activity, you must notify LX INDIA immediately so we can take appropriate action.LX INDIA will not be liable for any loss or damage caused by your failure to protect your account credentials or by unauthorized use of your account.

Account Suspension or Termination

LX INDIA reserves the right to suspend, restrict, or permanently delete your account without prior notice if we find that you have violated these Terms, engaged in fraudulent activity, or misused our systems in any way. Accounts may also be suspended if they are involved in actions that harm other users or the reputation of LX INDIA. If you wish to stop using the Platform, you may close your account anytime by contacting our support team or using the available account settings.

Use of the Platform

By accessing or using LX INDIA, you agree to use our Platform only forlawful, honest, and respectful purposes.You must not upload, post, or share any content that is false, misleading, harmful, abusive, or illegal. You must also not pretend to be another person, business, or brand. It is strictly prohibited to attempt to hack, damage, or copy any part of LX INDIA’s systems, software, or databases. You may not send spam, spread viruses, or use automated tools like bots or crawlers to collect data, copy product listings, or interfere with the functioning of the Platform.Additionally, posting comments, reviews, or feedback that promote other brands, competitors, or external websites within another seller’s product page is not allowed.You must not use LX INDIA’s review or Q&A sections to advertise unrelated services, redirect customers, or promote off-platform sales.LX INDIA reserves the full right to monitor, edit, or remove any listings, comments, or content that violates these rules or harms the reputation of other sellers, buyers, or the Platform as a whole.

Product Listings, Prices, and Availability

All products displayed on LX INDIA are listed by verified sellers who provide their own product details, prices, and images.We work hard to ensure that everything shown on our Platform is accurate, but sometimes mistakes may happen such as incorrect pricing, inaccurate stock information, or minor differences in product descriptions or photos.If any such error occurs, LX INDIA reserves the right to correct, update, or cancel an order before shipping. In such cases, we will inform you promptly.Product images and colors shown on our website or app may appear slightly different from the actual product because of lighting, screen settings, or manufacturer variations.All prices displayed are in Indian Rupees (INR) and normally include applicable taxes unless stated otherwise.

Prices, offers, discounts, and stock availability may change at any time without prior notice, depending on the seller’s policies or market conditions.

Orders and Payments
Placing an Order

When you place an order on LX INDIA, you are making an offer to purchase the selected item from the listed seller.Your order is confirmed once the payment has been successfully processed and you receive a confirmation email or SMS. The seller then prepares the order for shipment according to their inventory and delivery timelines.Please review your order details carefully before confirming, including product information, address, and payment method, as changes after confirmation may not always be possible.

Payment Methods

LX INDIA supports multiple secure payment options, including Credit/Debit Cards, Net Banking, UPI, Wallets, and Cash on Delivery (COD) for eligible orders.

All online payments are processed through trusted, PCI-DSS-compliant payment gateways to ensure your data remains secure. LX INDIA does not store or have access to your complete card details, passwords, or CVV numbers.For COD orders, payment must be made in full to the delivery partner at the time of delivery. Failure to do so may result in account restrictions or order cancellation.

Failed Transactions

If a payment fails but your bank account has been debited, the deducted amount will automatically be refunded by your bank or payment provider, usually within 5–7 business days.In case of any delay, you can contact your bank or raise a support request through LX INDIA’s help section for quick assistance.

Shipping, Delivery, and Tracking

LX INDIA works exclusively with verified logistics and courier partners to ensure safe and timely delivery of products sold on the platform. All sellers are using the delivery partners approved by LX INDIA for shipping their products to you. Once a seller hands over an order to the assigned delivery partner, they will update the shipment tracking ID on the LX INDIA platform to enable you to monitor the delivery progress directly through your order page. Delivery timelines depend on factors such as product type, seller location, and customer address, and may vary due to regional restrictions, courier capacity, or unforeseen conditions like weather disruptions. If a delivery attempt fails because the customer is unavailable, our courier partners will make re-delivery attempts. Orders may be cancelled and returned to the seller after multiple failed attempts. LX INDIA is not liable for delays caused by natural events, strikes, or inaccurate delivery details provided by the buyer. To ensure smooth order fulfillment, buyers are advised to verify their address and contact information before confirming the purchase.

Cancellation, Returns & Refunds

LX INDIA is committed to a transparent and customer-friendly cancellation and refund process.

Cancellation

You may cancel your order within 30 minutes of placing it without any charges. After 30 minutes, cancellation is still allowed, but a cancellation fee of 2.5% will be deducted from the refund amount. If you cancel the order after it has been processed, a cancellation charge of 10% of the order amount will be deducted. Sellers and admins also reserve the right to cancel orders in cases such as incorrect or misleading product descriptions, out-of-stock items, unauthorized product listings, or any other policy violations. If the seller or admin cancels the order, your full amount will be refunded to your original payment method. All approved refunds will be processed within 7-10 working days. Please note that once the shipment has been dispatched, cancellation is no longer allowed.

Returns

You may request a return if you receive a wrong, defective, or damaged product, or if the item does not match the description shown on our Platform.Returned products must be unused, in their original packaging, and must include all accessories, manuals, and tags. The product shall not be opened if any damage or discrepancy is prima facie evident upon receipt. You should initiate the return request within the time period mentioned on the product description or within 7 days from date of delivery . After verification, the seller or LX INDIA’s partner courier will arrange a pickup of the product. Once the item is inspected and approved, your refund will be processed.

Refunds are initiated only after successful inspection of the returned product.The refunded amount will be credited to your original payment method within 7–10 business days, depending on your bank or payment service provider.

2. Perishable Good
3. software licenses
4. Products in consumable nature (Wax candles, Wall stickers and all other products in same nature)
5. All inner apparel, socks, gym supporters, guards, swimsuits
6. For all Wind Instruments (Harmonicas and Flutes) due to hygiene/health and personal care/wellness nature of the product.
7. Personal Care Appliances like Beauty/Oral Care Products and Appliances
8. Giveaway products

All other products which are published as Non-Returnable/ Final sale in the product description or clearance items are not eligible for return or exchange due to safety or policy reasons.

Sellers and Product Responsibility

LX INDIA acts solely as an intermediary platform that connects buyers and verified sellers. We are not the manufacturer, owner, or direct seller of most products listed on the Platform unless specifically mentioned.Each seller is independently responsible for ensuring that their products are authentic, legally compliant, and safe for consumer use.

They are also responsible for packaging, shipping, invoicing, warranties, and post-sale support. Before any seller is allowed to list on LX INDIA, we conduct a verification and screening process to ensure their legitimacy and quality standards.

However, LX INDIA cannot guarantee every product’s performance, lifespan, or compatibility.If you encounter any issue with a product or seller, our support team will help mediate the problem and guide you toward a fair resolution between both parties.

Product Warranty

Some products listed on LX INDIA may come with a manufacturer’s or seller’s warranty. You can claim this warranty directly through the respective brand’s authorized service center or the seller’s support channel. LX INDIA itself does not provide any product warranty unless the item is officially sold or fulfilled by LX INDIA. Warranty coverage, duration, and claim conditions depend entirely on the product category and the manufacturer’s policy. We recommend that you keep your purchase invoice and product packaging safe for future warranty claims. However, LX INDIA offers assistance to guide you through the warranty claim process by helping you connect with the concerned brand or seller whenever support is required.

Reviews, Ratings, and Feedback

LX INDIA values honest and constructive feedback from its users. Reviews help other buyers make informed choices and help sellers improve their offerings.When you post a review, please ensure that your feedback is truthful, respectful, and based on your actual experience with the product or seller. Avoid using offensive language, personal attacks, or sharing false or misleading information. Reviews that promote other brands, contain spam, or attempt to damage reputations will be removed.By submitting your review, you grant LX INDIA permission to use it in full or in part on our website, mobile app, or promotional materials, including social media or advertisements, while crediting it to your display name.

Intellectual Property Rights

All content available on LX INDIA, including but not limited to text, graphics, designs, images, product layouts, icons, logos, videos, and software, is protected by copyright, trademark, and other intellectual property laws.These rights belong exclusively to LX INDIA or its content licensors and partners.You are not allowed to copy, modify, reproduce, sell, display, or distribute any part of LX INDIA’s content or design without prior written permission.Using our content for commercial purposes, resale, or imitation is strictly prohibited and may lead to legal action or suspension of your account.You may, however, use the Platform for personal and lawful purposes such as browsing, sharing product links, or making purchases.

Account Suspension, Restriction, and Termination

LX INDIA reserves the right to suspend, restrict, or permanently terminate a buyer’s account, with or without prior notice, if the user violates any terms, engages in misconduct, or poses a risk to the platform or its users. An account may be limited or closed for breaching the Terms of Use, providing false or misleading information, or misusing features such as reviews, returns, offers, or customer support. Fraudulent or suspicious behaviour including the use of stolen payment methods, unauthorized transactions, fake orders, return or refund abuse, manipulation of discounts, or attempts to deceive sellers or staff may result in immediate suspension. Any attempt to hack or interfere with the website or app, access restricted areas, use bots or automated tools, upload harmful code, bypass security measures, or exploit system vulnerabilities can also lead to account closure. Abusive, harmful, or illegal conduct such as harassment of sellers, delivery partners, or support agents, posting unlawful or offensive 

FAIR USAGE POLICY

We always strive hard to provide the best experience to our customers on the Platform. To ensure that all customers use our Platform in good faith, we keep track of customer behaviour, which includes maintaining order history and other details relating to the manner of use of our Platform. In the event of any abuse of our Platform or our policies, which includes excessive returns, refusal to accept shipments, or any indication of fraudulent or suspicious activity or behaviour on our Platform, or association with any such activity or behaviour, including cases where your user metrics such as claim rate or return rate are higher than the average rate of other users on our Platform, we reserve the right to take necessary actions. In such cases, certain benefits available to other users may not be available to you, and we may take actions including but not limited to blocking any user from transacting on the Platform, levying a service fee, discontinuing COD options, blocking COD payments, blocking refund claims

DISCLAIMER

YOU ACKNOWLEDGE AND AGREE THAT YOU ARE ACCESSING THE LX INDIA PLATFORM AND CONDUCTING TRANSACTIONS AT YOUR OWN RISK, USING YOUR BEST AND PRUDENT JUDGMENT BEFORE ENTERING INTO ANY TRANSACTION, AND LX INDIA SHALL NOT BE LIABLE FOR ANY ACTIONS OR INACTIONS OF SELLERS OR FOR ANY BREACH OF CONDITIONS, REPRESENTATIONS, OR WARRANTIES BY SELLERS OR MANUFACTURERS OF THE PRODUCTS, AND EXPRESSLY DISCLAIMS ALL RESPONSIBILITY AND LIABILITY IN THIS REGARD; LX INDIA SHALL NOT MEDIATE OR RESOLVE DISPUTES BETWEEN YOU AND SELLERS OR MANUFACTURERS AND DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES REGARDING THE QUALITY, SUITABILITY, ACCURACY, RELIABILITY, COMPLETENESS, TIMELINESS, PERFORMANCE, SAFETY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, LEGALITY OF THE PRODUCTS, OR ANY CONTENT ON THE PLATFORM, WITH THE PLATFORM AND ALL RELATED CONTENT MADE AVAILABLE ON AN "AS IS” BASIS WITHOUT WARRANTY OF ANY KIND; AT NO TIME SHALL ANY RIGHT, TITLE, OR INTEREST IN THE PRODUCTS SOLD THROUGH OR DISPLAYED ON THE PLATFORM VEST WITH LX

Limitation of Liability

In no event shall LX India be liable to users for any indirect, punitive, incidental, special, consequential, or other damages whatsoever, including without limitation damages for loss of use, data, or profits, arising from the use or inability to use the platform, unauthorized access to data, breaches by sellers or manufacturers, platform unavailability, disputes with sellers, or any other matter relating to the services. buyers use the platform at their own risk, and LX India's total liability shall not exceed the total commission fees paid by the sellers in the three months preceding the claim.

Indemnification

You agree to defend, indemnify, and hold harmless LX INDIA, its directors, officers, employees, agents, representatives, successors, and assigns from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorney’s fees) arising out of or resulting from your acts or omissions, including but not limited to:

(a) any breach of warranties, representations, or undertakings made by sellers under this User Agreement;

(b) failure to perform or fulfil any of your obligations hereunder.

(c) violation of any applicable law, regulation, or third-party right, including intellectual property rights, data protection laws, or payment of statutory dues and taxes

(d) any claim of libel, defamation, invasion of privacy, or infringement of rights of publicity or other proprietary rights. This indemnity obligation shall survive the termination or expiry of this User Agreement.

Entire Agreement

The failure of LX India to exercise or enforce any right or provision of these Terms of Use shall not be deemed a waiver of such right or provision. These Terms of Use, along with any policies or operating rules posted by LX India on the Platform in relation to the Services, constitute the entire agreement and understanding between you and LX India and govern your use of the Services, superseding all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and LX India, including any previous versions of these Terms. Any ambiguities in the interpretation of these Terms of Use shall not be construed against the drafting party.

Force Majeure

LX INDIA shall not be held liable or responsible for any delay, failure, or inability to perform any of its obligations under this Agreement if such delay or failure results, directly or indirectly, from events or circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, epidemics, pandemics, war, terrorism, governmental actions, labour disputes, strikes, embargoes, or any other cause of a similar nature

Governing Law And Jurisdiction

This terms of use shall be construed in accordance with the applicable laws of India. The Courts at Mavelikara, Kerala, India shall have exclusive jurisdiction in any proceedings arising out of this agreement.

Severability

If any provision in this agreement is, for any reason, held to be invalid, illegal, or unenforceable in any respect, that invalidity, illegality, or unenforceability will not affect any other provisions of this agreement, but this agreement will be construed as if the invalid, illegal, or unenforceable provisions had never been contained in this agreement, unless the deletion of those provisions would result in such a material change that would cause completion of the transactions contemplated by this agreement to be unreasonable.
